Welcome to The Charles Elliott Laundry Co. Ltd. These Terms and Conditions (“Terms”) govern the provision of commercial laundry and linen hire services by The Charles Elliott Laundry Co. Ltd (“Company”, “we”, “our”, or “us”) to clients (“Client”, “you”, or “your”) operating within the hospitality sector.
Services Provided
We provide professional commercial laundry and linen hire services, including but not limited to the collection, laundering, delivery, and return of linens, towels, uniforms, and textiles.
Service Agreements
All services are subject to a written agreement, service schedule, or confirmed quotation. Use of our services constitutes acceptance of these Terms.
Pricing and Payment
Prices are exclusive of VAT. Invoices are issued as per agreement (weekly/monthly). Payment terms are agreed in writing prior to service commencement. Late payments may result in service suspension and accrue interest at 5% above the Bank of England base rate. The Company reserves the right to recover costs associated with debt recovery.
Hired Linen
All hired linen remains the property of The Charles Elliott Laundry Co. Ltd at all times. Clients are responsible for the safekeeping and reasonable use of hired items. Charges apply for lost, damaged, irrecoverably stained, or misused items at current replacement rates from our suppliers. Counts and discrepancies are recorded on delivery/collection. Unreturned items will be invoiced accordingly.
Client-Owned Linen
We also process linen owned by clients. All such items are cleaned strictly at the Client’s risk. We are not liable for pre-existing damage, wear and tear, shrinkage, colour loss, or fabric weakness. It is the Client’s responsibility to ensure that items are suitable for commercial laundering.
Delivery and Collection
We operate scheduled delivery and collection services. While we aim for punctuality, we are not liable for delays caused by traffic, weather, breakdowns, or other circumstances beyond our control.
Loss, Damage & Liability
We take reasonable care with all items. Our liability for loss or damage is limited to the lesser of (a) the depreciated value of the item, or (b) £50 per item. Claims must be submitted in writing within 48 hours of delivery. No liability is accepted for any indirect or consequential loss.
Client Responsibilities
Clients must ensure that items presented for laundering are free from hazardous materials (e.g., sharps, bodily fluids). Items unsuitable for commercial processing may be refused. The Client is liable for any injury or damage caused by contaminated items.
Force Majeure
We shall not be held liable for failure to perform our obligations due to events beyond our control, including but not limited to strikes, fire, floods, pandemics, or supplier failures.
Termination
Termination of services must be carried out in accordance with the notice period specified in the individual service agreement or contract. In the absence of a specific agreement, a reasonable notice period will apply. The Company reserves the right to suspend or terminate services immediately in cases of non-payment, misuse of service, or material breach of these Terms.
Governing Law
These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the English courts.
